FamilyAide Terms of Use

  1. Introduction

Welcome to the FamilyAide website (the “Site”). By using this Site and engaging with our services, you (“you” or “the Client”) agree to the following Terms and Conditions. These terms govern your access to and use of the Site, including the services provided by FamilyAide. Please read these Terms and Conditions carefully before using our services. If you do not agree to these terms, please do not use our Site or services.

By using our Site or services, you consent to receive communications from FamilyAide, including via SMS, phone calls, and emails. These communications may relate to services, appointments, and promotional content. You acknowledge and agree that:

SMS/Phone/Email: FamilyAide may contact you by text message, phone, or email to inform you about your care, services, and special offers. If you do not wish to receive these messages, you may opt out by replying “STOP” to any SMS message, or by contacting us directly to unsubscribe from email communications.

Data Collection: We collect personal information such as your name, contact details, and health-related data to provide our services. This information is used solely for the purposes of delivering and improving our care services.

Third-Party Sharing: FamilyAide may share your information with third parties or affiliates for marketing or promotional purposes.   1. Payment Terms

Payment Schedule: Payments for services rendered will be made as per the agreed upon terms.

  1. Cancellations and Rescheduling

Agency Cancellations: We reserve the right to cancel or reschedule services in case of emergencies or unforeseen circumstances. We will notify you as soon as possible.

  1. Confidentiality

FamilyAide is committed to protecting your personal information. Health-related information will not be shared under any circumstances. However, basic information, such as contact details, mobile information, and service preferences, may be shared with our affiliates or trusted third-party partners for marketing or promotional purposes. We will ensure that any shared information is handled with care and used solely for the purposes of improving your experience with our services. All information will be treated in accordance with applicable laws and regulations.

  1. Client Responsibilities

Accurate Information: You agree to provide accurate and complete information about the care needs of the person receiving services.

Safe Environment: You are responsible for ensuring that the environment is safe for both the caregiver and the individual receiving care. If unsafe conditions are discovered, services may be temporarily suspended until the situation is resolved.

  1. Release of Claims

In consideration of the services provided by FamilyAide, you agree to release FamilyAide from any and all claims, causes of action, lawsuits, injuries, damages, losses, liabilities, or other harms resulting from or relating to calls, text messages, emails, or other messages, including but not limited to:

Any claims, causes of action, or lawsuits based on any asserted violations of the law (including, without limitation, the Telephone Consumer Protection Act (TCPA), Truth in Caller ID Act, CAN-SPAM Act, Fair Debt Collection Practices Act (FDCPA), Fair Credit Reporting Act (FCRA), Health Insurance Portability and Accountability Act (HIPAA), and any similar state or local laws or statutes, as well as any federal or state tort or consumer protection laws).

  1. Liability

Limitation of Liability: FamilyAide will not be held liable for any personal injury, loss, or damage caused by the Client’s negligence or actions. This includes unsafe home conditions or improper supervision.

Caregiver Injury: In the event of caregiver injury, FamilyAide will follow all appropriate protocols to handle the situation fairly and responsibly.

  1. Dispute Resolution

If any issues or disputes arise regarding our services, we encourage you to contact us directly. If we cannot resolve the dispute informally, we may proceed with mediation or arbitration in accordance with Michigan state laws.

  1. Changes to Terms

FamilyAide reserves the right to modify or update these Terms and Conditions at any time. Any changes will be communicated to you, and your continued use of our services will signify acceptance of the revised terms.

  1. Governing Law

These Terms and Conditions are governed by the laws of the State of Michigan. Any disputes arising from or related to these terms will be resolved in accordance with Michigan law, and any legal action shall be brought in the state or federal courts located in Michigan.
